Regardless of the terms and conditions of the e-commerce contract that has been entered into, the consumers, in general, can freely cancel the contract within the period of the cancellation of the contract (generally 7 days)
(in accordance with Article 17(1) of the Act on Consumer Protection in Electronic Commerce, etc.).
However, in any of the following cases, order cancellation and product return shall not be allowed against the wish of the Internet shopping mall operator
(Provision in Article 17(2) of the Act on Consumer Protection in Electronic Commerce, etc., and Article 21 of the Enforcement Decree of the Same Act):
1. Where the product has been lost (totally destroyed to the extent that it cannot function) or damaged due to the consumer's fault (however, if only the packaging is damaged to check the content, cancellation or return is possible.);
2. Where the value of the item has been clearly reduced due to the use of the object by the consumer;
3. Where the value of the item has fallen so seriously that it is difficult to resell it over time;
4. Where the packaging of a reproducible item has been damaged;
5. Where the provision of a service or digital content falls under Subparagraph 5 of Article 2 of the Framework Act on the Promotion of Cultural Industries, except for parts which have not been provided in the case of a contract for an additional service or additional digital content; and
6. In the case of withdrawal or cancellation of a contract for a product separately produced based on a consumer’s request or a similar product, where the Internet shopping mall operator has informed the consumer in advance that the order will not be canceled or returned due to significant irreparable damage to the Internet shopping mall operator and has obtained the consent in writing (including e-documents) from the consumer.
